Lord Fusitu’a

7 August 2020 The Lord Speaker of Tonga Legislative Assembly, Lord Fakafanua, issued a writ for the election of Noble’s Representative for Niuatoputapu and Niuafo’ou according to section 6 of the Legislative Assembly Act.

Lord Fusitu’a was the Noble Representative for Niua until the position is vacant on the 6th of August 2020 according to section 7 of the Legislative Assembly Act.

The provision requires Member of the Parliament not to be absent from the Legislative Assembly for more than 12 consecutive calendar months as his tenure will end and his seat in the Legislative Assembly shall be vacant.

The Parliament of Tonga website stated that Lord Fusitu’a has been absent from the Legislative Assembly’s meeting since the 5th of August 2009 due to his illness.

The time and place for the by-election will be announced once it has been set by the Electoral Commission in consultation with the Lord Speaker.

The Legislative Assembly of Tonga recognises with deep appreciation the valuable contribution by Lord Fusitu’a to the work of the Assembly during his time as the Nobles’ Representative of Niuatoputapu and Niuafo’ou in the Legislative Assembly of Tonga.

6 Death, resignation or disfranchisement of Member
If any representative shall die or shall resign his seat or shall cease to be qualified
for election under clauses 23 and 65 of the Constitution or be unseated in accordance
with clause 66 of the Constitution or the provisions of the Electoral Act, his seat in the Legislative Assembly shall thereupon become vacant and the Speaker of the
Legislative Assembly shall issue a writ for the election of a successor. The Electoral
Commission in consultation with the Speaker shall thereupon fix the time and place of such election and the person elected thereat shall hold office for the balance of the
term of his predecessor

7 Member absenting himself
If any representative shall be absent from the Legislative Assembly for more than 12
consecutive calendar months, or except on the ground of illness, for a period of 2
weeks during the session of the Legislative Assembly, without leave of the Speaker,
his seat in the Legislative Assembly shall thereupon become vacant and his
successor shall be determined in accordance with the provisions of section 6
hereof.
